Acceptance of terms

By downloading, installing, accessing, or using any of our Services, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, and any additional in-game terms or rules we may publish from time to time. If you do not agree, you must immediately stop using the Services and uninstall them from your device.

If you accept these Terms on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

Eligibility

To use our Services, you must:

• Be at least 13 years old (or 16 in jurisdictions where 16 is the minimum age of digital consent, including most of the European Economic Area and the United Kingdom);
• If you are a minor, have the consent of a parent or legal guardian who has read and accepted these Terms on your behalf;
• Have the legal capacity in your jurisdiction to enter into a binding contract;
• Not be prohibited from using the Services under any applicable law (for example, persons on a sanctions or denied-parties list).

We reserve the right to refuse service, close accounts, or restrict access at our discretion, including where we have a reasonable belief that a user is below the minimum age.

Your account

Some features may require you to create a profile or sign in via a third-party account (such as Google Play Games, Apple Game Center, or a social account). You are responsible for:

• Maintaining the confidentiality of your account credentials and any device that has the game installed;
• All activities that occur under your account;
• Promptly notifying us of any unauthorized use, breach, or suspicious activity.

We are not liable for any loss or damage resulting from your failure to keep your account secure or from unauthorized access. You may not transfer, sell, lease, or otherwise allow another person to use your account without our written permission.

License to use

Subject to your compliance with these Terms, Gung Park grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use our games on a mobile device that you own or control, solely for your personal, non-commercial entertainment.

You agree not to:

• Copy, modify, adapt, translate, reverse-engineer, decompile, or disassemble the Services, except where this is permitted by mandatory local law;
• Distribute, sell, lease, sub-license, or otherwise exploit the Services for commercial purposes;
• Remove, obscure, or alter any proprietary notices, copyright, trademark, or other ownership marks;
• Use the Services to develop a competing product or service;
• Use any robot, scraper, automated tool, bot, modified client, or memory-editor to interact with the Services;
• Interfere with or attempt to circumvent any security feature, anti-cheat system, or DRM;
• Use the Services in a way that could overload, damage, or impair our infrastructure.

All rights not expressly granted to you in these Terms are reserved by Gung Park and our licensors.

In-app purchases

Our games may offer items, features, or virtual currency that can be purchased with real money ("In-App Purchases" or "IAPs"). All purchases are processed by the platform on which you downloaded the game — Google Play Billing on Android or Apple StoreKit on iOS. We do not directly receive or store your payment card or banking details.

By making an In-App Purchase you agree that:

• You are at least the age of legal capacity to enter into a binding purchase contract in your jurisdiction, or have the consent of a parent or legal guardian;
• The price you see at checkout includes any applicable taxes, unless otherwise indicated;
• The payment is final once processed by the platform, except as required by mandatory consumer law or as described in Section 7 below;
• You are solely responsible for any costs associated with your payment method, including overdraft fees, currency conversion charges, or unauthorized use of your account.

Virtual items & currency

"Virtual items" means any in-game content — including currency (gems, coins, gold, tickets), characters, cards, decorations, boosters, lives, energy, and other consumable or non-consumable assets. You acknowledge and agree that:

• Virtual items have no real-world monetary value and cannot be redeemed for cash or anything of monetary value outside the Services;
• You do not own virtual items — instead, you receive a limited, personal, non-transferable license to use them within the relevant game while your account is active;
• Virtual items are non-transferable between accounts unless we specifically allow it;
• We may, at our discretion, modify, remove, replace, balance, increase or decrease the price of, or expire virtual items at any time, including without notice;
• You may forfeit unused virtual items if your account is suspended, terminated, or if a game is discontinued (subject to mandatory consumer-law refund rights).

Refunds & cancellations

Because In-App Purchases are processed by Google Play or the Apple App Store, refund requests must generally be made directly to the platform you purchased from:

• Google Play — request a refund through your Google Play account or via play.google.com/store/account/orderhistory within the timeframe permitted by Google's policies.
• Apple App Store — request a refund using reportaproblem.apple.com in accordance with Apple's policies.

If you live in a jurisdiction with mandatory consumer-protection laws granting a right of withdrawal (for example, the EU's 14-day distance-selling rules), those rights remain available to you. By starting to use a digital product immediately after purchase (e.g., spending in-game currency), you may forfeit certain withdrawal rights to the extent permitted by law.

If you believe a purchase was incorrectly processed (for example, you were charged but did not receive the item), please contact our support team and we will work with you and the platform to resolve the issue.

Advertising in our games

Many of our games are free to download and supported by advertising. By using a free game, you agree that we may display advertisements, including:

• Banner ads — small ads typically shown at the top or bottom of the screen;
• Interstitial ads — full-screen ads shown at natural transition points;
• Rewarded ads — optional video ads you can choose to watch in exchange for in-game rewards.

Some games may offer a paid option to remove or reduce advertising. Where available, this option will be shown in the in-game shop. Where you have opted into rewarded advertising, you understand that the reward is only granted when the ad is fully viewed.

Information collected for advertising purposes is described in our Privacy Policy.

User conduct

You agree to use the Services only for lawful purposes and in compliance with these Terms. In particular, you agree not to:

• Cheat, exploit bugs, use unauthorized third-party software, mods, hacks, memory editors, or automated tools that interfere with normal gameplay;
• Engage in fraud, including chargeback abuse, fake purchases, or fraudulent ad clicks/views;
• Attempt to gain unauthorized access to other accounts, devices, or our systems;
• Harass, threaten, defame, impersonate, or stalk another player or person;
• Post or transmit content that is unlawful, harmful, obscene, hateful, racist, sexually explicit, or otherwise objectionable;
• Use the Services to transmit any virus, worm, trojan, or other malicious code;
• Disrupt or interfere with the Services, our servers, or the experience of other users;
• Collect, store, or use other players' personal information without consent;
• Sell, trade, or transfer accounts or virtual items outside of authorized in-game systems;
• Use the Services in any way that violates applicable laws, regulations, or third-party rights.

Violations may result in warnings, removal of content, loss of virtual items, account suspension or termination, and — where appropriate — referral to law enforcement.

User-generated content

Some of our games allow you to submit content — for example, a chosen display name, an avatar, a recorded voice clip used by an in-game mechanic (such as voice input that drives animal sounds in our games), comments, or screenshots ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant Gung Park a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, modify, adapt, translate, and create derivative works of that User Content for the purposes of operating, improving, and promoting the Services. This license terminates when you remove the User Content, except where the content has already been used in legitimate, public materials (such as a marketing post that has already been published).

You represent and warrant that:

• You own or have the necessary rights to submit your User Content and to grant the license above;
• Your User Content does not violate any third-party rights, including intellectual-property, privacy, or publicity rights;
• Your User Content complies with the conduct rules in Section 9.

We may, but are not obligated to, review, screen, or moderate User Content. We may remove or modify any User Content at our discretion, especially if it violates these Terms or applicable law.

Intellectual property

The Services and all content delivered through them — including game code, art, characters, music, sound effects, voice work, text, animations, trademarks, logos, brand names, and design — are the exclusive property of Gung Park or our licensors and are protected by copyright, trademark, and other intellectual-property laws.

Nothing in these Terms transfers any intellectual-property right to you. You may take screenshots, recordings, and live streams of gameplay for non-commercial personal use, including posting to social media, provided that you:

• Do not modify the content in a way that misrepresents Gung Park or the game;
• Do not claim authorship of the underlying game or its assets;
• Do not use our brand, logos, or trademarks in a way that suggests endorsement or sponsorship without our written permission.

If you believe any content in our Services infringes your copyright, please send a detailed notice in writing to copyright@gungpark.studio including: (a) identification of the copyrighted work, (b) identification of the allegedly infringing material, (c) your contact information, (d) a statement of good-faith belief, (e) a statement under penalty of perjury, and (f) your physical or electronic signature.

Third-party services

Our Services integrate with third-party services for advertising, analytics, attribution, social features, payments, and platform integration. Third-party services include but are not limited to: Google Firebase, Google AdMob, AppLovin MAX, Unity Ads, Meta Audience Network, AppsFlyer, Google Play Games Services, and Apple Game Center. These third parties have their own terms and privacy policies, and your use of them is governed by those terms.

Gung Park is not responsible for the practices or content of any third-party service. Inclusion of a third-party service in our Services does not imply our endorsement of that service.

Updates & availability

We may release updates, patches, new features, or new content from time to time. Updates may be required for the Services to function correctly. You agree that your device may automatically download and install updates, including security updates, depending on your platform settings.

We do not guarantee that the Services will be available at all times or in all locations. We may, at our discretion:

• Modify, suspend, or discontinue any part of the Services, with or without notice;
• Take any game offline for maintenance, balancing, or operational reasons;
• End-of-life ("sunset") a game when it is no longer commercially viable. Where required, we will give reasonable advance notice via in-game messaging or store listings.

Suspension & termination

You may stop using the Services at any time by uninstalling the apps from your device. To delete your account or in-game data, please follow the instructions in Section 15 of our Privacy Policy or contact support.

We may suspend or terminate your access to all or part of the Services at any time, with or without prior notice, if we have reason to believe that:

• You have violated these Terms or any applicable in-game rules;
• Your continued use poses a security or legal risk;
• You have engaged in fraudulent purchases, chargebacks, or unauthorized access;
• You have used cheats, modified clients, or third-party tools that affect gameplay integrity;
• We are required to do so by law, court order, or platform policy.

Upon termination, your license to use the Services ends immediately, and any virtual items associated with your account may be forfeited (subject to mandatory consumer-law refund rights). Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will continue to apply.

Disclaimers & warranties

We do not warrant that:

• The Services will meet your requirements or expectations;
• The Services will be uninterrupted, secure, error-free, or free from viruses or other harmful components;
• Any errors or defects will be corrected;
• The information obtained through the Services will be accurate or reliable.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Nothing in these Terms affects any non-waivable statutory rights you have as a consumer.

Limitation of liability

To the maximum extent permitted by applicable law, our total cumulative liability arising out of or relating to these Terms or your use of the Services will not exceed the greater of (i) the amount you paid to us through In-App Purchases in the twelve (12) months prior to the event giving rise to the claim, or (ii) USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited by law (such as liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence).

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Gung Park, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your access to or use of the Services;
• Your User Content;
• Your violation of these Terms or any applicable law;
• Your violation of any third-party right, including intellectual-property, privacy, or publicity rights.

Governing law

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

If you are a consumer residing in the European Economic Area, the United Kingdom, or another jurisdiction whose mandatory consumer law gives you rights that cannot be waived, those rights remain available to you and override any conflicting provision in this section.

Dispute resolution

If you have a dispute with Gung Park, please first contact us at nasenripolayoyo@gmail.com. Most issues can be resolved quickly and informally. If we cannot resolve a dispute within 60 days, the dispute will be resolved as follows:

• For users in Vietnam — the courts of Hanoi, Vietnam will have exclusive jurisdiction.
• For users in the European Economic Area — you may file a complaint with the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr, in addition to any other rights you have under your local consumer law.
• For all other users — disputes will be resolved by binding arbitration administered under the rules of the Vietnam International Arbitration Centre (VIAC), seated in Hanoi, in the English language, by a single arbitrator, except where mandatory law of your jurisdiction requires court proceedings instead.

You and Gung Park agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action, except where prohibited by applicable law.

Platform-specific terms

20.1 Apple App Store (iOS)

If you obtained one of our games from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Gung Park only — Apple is not a party.
• Apple has no obligation to provide any maintenance or support services with respect to the game.
• If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
• Gung Park (not Apple) is solely responsible for addressing any claims by you or any third party relating to the game, including product liability, regulatory non-compliance, or consumer-protection claims.
• In the event of a third-party claim that the game or your use of it infringes that party's intellectual-property rights, Gung Park (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms with respect to your license to the iOS game, and Apple has the right to enforce these Terms against you.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

20.2 Google Play (Android)

If you obtained one of our games from Google Play, your use is also governed by the Google Play Terms of Service. Google is not a party to these Terms but may be a third-party beneficiary with respect to your right to use the game on a device running Google's services.

Changes to these terms

We may update these Terms from time to time to reflect changes in our Services, business practices, or legal requirements. When we make material changes, we will:

• Update the "Last updated" date at the top of this page;
• Provide reasonable advance notice via in-game messaging, store listings, or our website;
• Where required, request fresh acceptance before the change takes effect.

If you continue to use the Services after the effective date of an updated version of the Terms, you accept the changes. If you do not accept the changes, you must stop using the Services.

Miscellaneous

Entire agreement. These Terms (together with our Privacy Policy and any in-game terms) constitute the entire agreement between you and Gung Park regarding the Services and supersede any prior agreements.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. Gung Park may assign these Terms freely, including in connection with a merger, acquisition, financing, or sale of assets.

Force majeure. We are not liable for any failure or delay in performance caused by events outside our reasonable control (including natural disasters, war, terrorism, riots, embargoes, civil or military authority actions, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, fuel, energy, labor, or materials).

Notices. We may give notices to you by in-game message, email (to the address associated with your account), or through our website. You may give notices to us by emailing the address in Section 23.

Language. These Terms have been drafted in English. Any translation is provided for convenience only; in case of conflict, the English version controls.
